Acceptance of Terms

By downloading, installing, or using Drift ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Moses Smith ("Developer," "we," "us," or "our") governing your access to and use of Drift.

Description of Service

Drift is an iOS application that serves as a "spontaneity engine" — it uses artificial intelligence to generate personalized activity and place suggestions based on your preferences, location, and context. The App is designed to help you discover new things to do and break out of routine.

Key features of the service include:

• AI-powered activity and place suggestions
• Personalized recommendations based on user preferences
• Location-aware suggestions for nearby activities

The App requires iOS 18 or later. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

Eligibility

You must be at least 13 years of age to use Drift. By using the App, you represent and warrant that you meet this age requirement.

If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf. Parents and guardians are responsible for supervising their minor's use of the App.

User Conduct

When using Drift, you agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the App
• Abuse, overload, or interfere with the App's API or backend services
• Use automated scripts, bots, or other tools to access or interact with the service in an unauthorized manner
• Circumvent, disable, or interfere with any security or access-control features of the App
• Use the App for any unlawful purpose or in violation of any applicable local, state, national, or international law
• Attempt to gain unauthorized access to any portion of the App or its related systems
• Redistribute, sublicense, or resell the App or any content generated by it

Violation of these terms may result in immediate termination of your access to Drift without notice.

AI-Generated Content Disclaimer

AI-generated content may include, but is not limited to, errors regarding:

• Business hours, seasonal availability, or temporary closures
• Location accuracy, addresses, or directions
• Pricing, fees, or admission costs for suggested activities or venues
• Safety conditions, accessibility information, or age-appropriateness
• Business names, descriptions, or the existence of suggested places

You assume all risk when acting on suggestions provided by Drift. Always independently verify information before visiting a location or participating in an activity. The Developer is not responsible for any consequences resulting from reliance on AI-generated suggestions.

Drift does not host or facilitate user-generated content. All content within the App is either developer-created or AI-generated.

Subscription Terms

Drift offers the following tiers:

Billing and Renewal: Premium subscriptions are managed and billed through Apple's App Store. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.

Cancellation: You can manage and cancel your subscription at any time through your Apple ID settings in the App Store. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for the remaining portion of a billing period.

Price Changes: We reserve the right to change subscription pricing. Any price increase will take effect at the start of your next billing cycle, and Apple will notify you in advance per their policies.

Refunds: All refund requests must be directed to Apple, as they handle all payment processing and billing for Drift subscriptions. The Developer does not process payments or issue refunds directly.

Intellectual Property

All content, features, and functionality of Drift — including but not limited to the app design, user interface, graphics, icons, text, code, algorithms, and AI models — are owned by Moses Smith and are protected by United States and international copyright, trademark, and other intellectual property laws.

Your use of Drift does not grant you any ownership rights in the App or its content. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

The Drift name, logo, and all related branding are trademarks of Moses Smith. You may not use these marks without prior written permission.

Limitation of Liability

To the maximum extent permitted by applicable law, Moses Smith shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Personal injury, property damage, or any harm resulting from visiting locations or participating in activities suggested by Drift
• Loss of data, revenue, profits, or business opportunities
• Errors, inaccuracies, or omissions in AI-generated content
• Service interruptions, downtime, or technical failures
• Unauthorized access to or alteration of your data

In no event shall the Developer's total liability to you for all claims arising from or related to your use of Drift exceed the amount you have paid for the App in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

Disclaimer of Warranties

Drift is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.

The Developer expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the service will be uninterrupted, timely, secure, or error-free
• Any warranty regarding the accuracy, reliability, or completeness of AI-generated suggestions
• Any warranty that the App will meet your specific requirements or expectations

No advice or information, whether oral or written, obtained from the Developer or through the App shall create any warranty not expressly stated in these Terms.

Termination

We reserve the right to suspend or terminate your access to Drift at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to:

• Violation of these Terms of Service
• Abuse of the App's API or backend infrastructure
• Conduct that the Developer reasonably believes is harmful to other users, the App, or the Developer
• Requests by law enforcement or government agencies

Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination (including, without limitation, Sections 5, 7, 8, 9, and 11) shall survive.

You may terminate your relationship with Drift at any time by deleting the App from your device and canceling any active subscriptions through the App Store.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict-of-law principles.

Any disputes arising from or relating to these Terms or your use of Drift shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You agree to waive any right to a jury trial or to participate in a class action.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page.

For material changes that significantly affect your rights or obligations, we will make reasonable efforts to notify you through the App or other appropriate means. However, it is your responsibility to review these Terms periodically.

Your continued use of Drift after the effective date of any changes constitutes your acceptance of the revised Terms.
